Tobacco 21 enforcement begins January 2018; retailer training to be held in October

Oregon Governor Kate Brown’s recent signing of SB 754, known as Tobacco 21 and recently passed by the Oregon Legislature, makes Oregon the fifth state to increase the age to purchase tobacco, after California, Hawaii, Maine and New Jersey. The new law takes effect immediately, with enforcement and fines to begin Jan. 1, 2018.

Enforcement of Tobacco 21 means:

  • Retailers and certified smoke shops can no longer sell tobacco products, inhalant delivery systems, or tobacco delivery systems to people younger than 21.
    • There are no exceptions for sales and use of tobacco or inhalant delivery systems, like e-cigarettes, to persons under 21 years of age.
  • Retailers and certified smoke shops that sell tobacco products or inhalant delivery systems are required to display a sign stating the prohibition of tobacco product or inhalant delivery system sales to persons younger than 21. Failure to post a sign stating this would be a Class A violation.

According to the 2015 Oregon Healthy Teens Survey, 16.4% of 11th graders in Benton County use tobacco products.

“There is still work to be done around tobacco prevention in Benton County. One in six Benton County 11th graders use tobacco products, including e-cigarettes,” said Bruce Thomson, Benton County Health Officer. “Most addiction to tobacco starts in adolescence. Most adults who smoke report that they started smoking before turning 18, and almost all start before they turn 26.”

The Partnership for Substance Abuse and Prevention, a partnership among Benton County Health Department, Oregon State University and several local alcohol retailers, is hosting a free retailer training on October 21, 2017 from 1:00-4:30 pm at the Corvallis Elks Lodge, 1400 NW 9th ST, Corvallis, OR 97330.

Attendees will increase their knowledge and skills around checking and identifying fake IDs, compliance checks, current laws and more. 50 spots are available and registration is required by October 18, 2017. Food will be provided. Register at
