No, each property account needs to have its own petition; however, you may submit both petitions at the same time

What if I am not able to attend the hearing?
If you are aware in advance of the days you will be unable to attend, please list those dates on the filed petition and our office will make every attempt to honor your request.

What if I decide to withdraw my Appeal Petition?
The Petitioner may withdraw their filed petition with a written request to the Benton County BoPTA Clerk. If a stipulation has been agreed upon between the Assessor Office and Petitioner prior to the board convening (early February), it is the responsibility of the Assessor Office to file the stipulation with the BoPTA Clerk in a timely manner.

What if I do not agree with the board decision?
The next level of appeal is at the Magistrate Division of Oregon Tax Court. The current fee to appeal at Magistrate is $252, you must file a legal complaint within 30 days after the BoPTA Order is mailed to you. For more information regarding Oregon Tax Court, you may visit their website.

What if I do not want to attend a hearing?
The board will be presented with the evidence submitted by you with your petition and make a decision after viewing the materials and hearing the Assessor representative presentation. You will be sent an Order of the board's decision.

What if I left some information off my petition?
After the BoPTA Clerk receives the filed petition, if there is information missing it is the responsibility of the Clerk to notify the Petitioner which items need to be perfected on the petition and the Petitioner has 20 calendar days from the date of mailing of the defective notice or until the last day for filing a petition (December 31st), whichever is the later date, to correct the defect in the petition.

What if the board decision is a value reduction?
Any tax refunds due as a result of a reduction in valuation decided by the board will be sent to the petitioner following the date the board officially adjourns, on or before April 15th. Although the decision may result in a reduction in real market value (RMV) that does not automatically mean that there will be a reduction of taxes.
